No-fault Divorce

Illinois is a modified "no-fault" state, which indicates that either party in a marriage can file for divorce on the grounds of "irreconcilable differences" without blaming the other spouse for wrongdoing. Illinois does require that grounds for the divorce be stated in the filing.

Although grounds may be as innocuous as "irreconcilable differences," other grounds may be falsely stated by your spouse that might affect your ability to spend time with your children, including:

• Domestic battery
• Domestic violence
• Physical abuse
• Habitual drunkenness
• Drug use
• Gambling

If you are innocent of such charges, you have additional reasons for hiring a legal representative to help you maintain your rights as a parent and property owner.

Negotiate or Litigate?

Divorce cases can be extremely contentious, leading to the necessity to resolve divorce issues in a trial. This is generally less practical and efficient than negotiating a divorce settlement with your spouse. However, if you choose to litigate your divorce, I am fully prepared to argue your case in court.
