What Is a Relocation in Illinois?

Under Illinois law, a “relocation” is not just any move. It is a move of a specific distance from the child’s current primary home. A parent with the majority of parenting time or with equal parenting time must follow the legal requirements of relocation if they plan to:

  • Move more than 50 miles to a new residence within Illinois.
  • Move more than 25 miles to a new residence within Illinois if the current home is in Cook, DuPage, Kane, Lake, McHenry, or Will County.
  • Move more than 25 miles to a new residence in another state.

Failing to follow the proper procedure for an eligible move can have serious legal consequences.

The Legal Process for Relocation

The parent intending to relocate must provide formal written notice to the other parent at least 60 days before the date of the intended move. This notice must include the intended date, the new address if known, and the duration of the move (if not permanent).

  • If Parents Agree: If the non-relocating parent agrees to the move and signs the notice, it can be filed with the court. The court will then approve the relocation and modify the existing parenting plan accordingly, as long as it is in the child’s best interest.
  • If Parents Disagree: If the non-relocating parent objects or otherwise does not sign the notice, the parent seeking to move must file a formal petition with the court asking for permission. It is then up to a judge to decide.

The court will evaluate a series of factors to determine if the relocation is in the child’s best interests. These factors typically include the reasons for the move, the reasons for the objection, the quality of each parent’s relationship with the child, the educational opportunities available in both locations, and the overall impact the move will have on the child.
